Can anyone throw any light on the following situation:
I have an employee in my company for the last 15 years. He was on full-time hours (9 to 5 - 5 days a week) for most of this time but in the recent downturn has been on a two-day week since Jan 2009 and the company is struggling. There is no contract of employment as we are a small private limited family company of 4 employees and just never set one up. He has now requested to be made redundant.
My questions are:
Is he entitled to demand the statutory redundancy due to his situation ?
As the company does not have the funds to pay this redundancy what is the procedure ?
