redundancy entitlement

Info Please


I have been working for a company for 10 years
6 Months ago I was put on a three day week
4 months ago I was asked to go back full time on reduced wage(to be reviewed in 6 months)now there is talk of insolvency/liquidation
am I entitled to redundancy? and who pays?
Also will I be assessed at the higher or lower wage?

any advice would be appreciated

once you have 104 weeks (2 years) continous service you are entitled to redundancy. If you have been working a 3 day week for longer than a year you would be paid at the lower rate but the fact that you are only 6 months doing it you are entitled to be paid at the higher rate. check out the department of enterprise trade and innovation website and click on redundancy payments all the info is there

Sorry for hijacking this thread, but did'nt want to start another one and the topic was simular, is this the lower rate that's referred to in the previous post.

Employee's on short time since Jan 09 - only geting work when work available sometimes only one/two days a month. Unfortunately, employee never wrote to ask to be re-instated full time (or even asked verbally as could see that there was no work). I got this info from Employment Rights but just wanted to double check.

When calculating redundancy is the following correct:

Go back 13 weeks from date of Notice and then take the average wage of the 26 weeks prior to work out the weekly gross wage.

With regard to my previous post (i don't mean to bump post) the information given to me by NERA seems to be incorrect... Thank god I double checked again with NERA...

A person who had been a fulltime (39hr wk) worker who now is on Job Seekers since Jan 09 and only geting work with his/her employer maybe 1 day one week then no work for two weeks or more and them maybe if they are lucky 3 days the next week or two - is the proper term for their employment Short Time.

If so Redundancy is based on the full gross weekly wage with the periods of no work calculated as breaks.

Could someone confirm if this is correct. Thank you.



Now I have just got information from Citizens Information - Reduced Hours and Short-time Work - both are based on the reduced payment!!!!! Talk about confused
