Redundancy entitlement period after company taken over

My mother in law is being made redundant from her job in a Pharmacy. She worked in that Pharmacy since 2000 but the Pharmacy was bought over by existing ownership in 2006. As a result they are only offering her the three years redundancy that she has been employee of theirs. Is this legal?
 
If you do a search for TUPE you should find the relevant information.(transfer of undertakings,protection of employees)
 
No it is not legal your mother is entitled to redundancy since she started with the business.
 
Your mother is either entitled to Redundancy from the old Company or she needs written confirmation from the Company and the DETE that her years of service and PRSI contributions are being carried over to the new Company. If she gets this she will be seen to be changing employer but continuing on her contributions.

That is my understanding of TUPE.
