Redundancy advice in relation to base salary.

Hi ... looking for some advice in relation to VSP offer from the company I work for. Some background info first! I worked shift work up until Jan of this year. On my pay slip, my pay was broken down as follows: Salary (which represented base pay), shift allowance and standard O/T. In Jan I was ask to work on a different work project which meant going onto a regular work week. This was meant to be only temporary but the project is still ongoing (There was no contract signed). Before undertaking the project I negotiated to keep my full shift allowance along with my base for the duration of the project. Since then the base pay & shift allowance are calculated together & represented as one figure on my payslip underneath salary, now representing base salary.

The VSP offer is based on a weeks base pay. My question is should the VSP be based on my original base pay as before when on shift or the base as represented now on my pay slip & at time of VSP offer? The company I am working for indicate it is based on original base pay, i.e excl. shift allowance.

Statute determines the minimum severance package you can receive.

as you are receiving a vsp (and presuming it's in excess of statutory provisions), then it is really up to the employer to make clear what the terms are.

- and for you to negotiate with them if you aren't happy with it.
