Excellent advice. The RTB will use literally any mistake to deem the notice of termination invalid. Tenants can avail of NGOs who will point out these mistakes and lodge RTB appeals.I would actually go one step further and get your solicitor to both draft and issue the notice of termination. It is surprisingly easy to make a mistake.
Just as easy for Solicitor to make a mistake!surprisingly easy to make a mistake.
The worst that can happen is RTB says your docs are wrong. So you have to redo them.cost of getting this wrong is potentially very large
Not really.Just as easy for Solicitor to make a mistake!
It sure does.It delays the termination date
That's always a risk - paying a solicitor doesn't mitigate in the slightest.the tenant would be likely to stop paying rent or caring for the property.
No disrespect to our legal professionals, but they make mistakes just like the rest of us.Solicitors are specifically trained to draft legal documents, work out notices periods
That’s obviously not the primary reason for engaging a solicitor to draft and issue a legal notice. If you are happy to pay legal fees on the off chance it will give you someone to sue if things go pear shaped - have at it!
A solicitor will provide a materially better chance of ensuring the process will be followed to the letter.NOT is a different kettle of fish.
From the cases I've read, the issue is not following the process.
Obviously wasn't clear, if I was selling and had tenants in situ then yes I'd engage Solicitor to look after NOT etc.So far as the sale goes, of course you need to engage a solicitor.
NOT is a different kettle of fish.
