Recommend a Solicitor to do notice of termination

Hi,

I've rented out a house on a 1 year fixed term lease and we would like to sell at the end of the lease, I would like a solicitor who specialises in landlord/tenant law to handle all the necessary paperwork to make sure the tenant and authorities are properly informed of termination in good time. The tenant is fine with this and rented in the knowledge it was for 12 months but I want to make sure there are no surprises.

I do my own paperwork & my regular Solicitor as needed for affidavits etc.

If you are reasonably conscientious and detail oriented, all the docs and info are on the RTB site.

My advice would be to serve notice that you require property for your own use.
 
You need a statutory declaration drafted and witnessed which more or less requires the services of a solicitor.
 
I would actually go one step further and get your solicitor to both draft and issue the notice of termination. It is surprisingly easy to make a mistake.

And the solicitor’s costs should be deductible for tax purposes.

Any decent solicitor should be able to handle this work - I don’t think you need a specialist.

Excellent advice. The RTB will use literally any mistake to deem the notice of termination invalid. Tenants can avail of NGOs who will point out these mistakes and lodge RTB appeals.

The cost of getting this wrong is potentially very large.

Not really.

Solicitors are specifically trained to draft legal documents, work out notices periods, etc.

And in the unlikely event that your solicitor does make a mistake, you at least have somebody to look to for compensation - that’s why they are required to carry PI insurance.

It sure does.

Threshold could well advise the tenant to wait until the very end of the (recently extended) notice period before raising any objection and the tenant would be likely to stop paying rent or caring for the property.

Getting the notice of termination wrong could be a very expensive mistake.

No disrespect to our legal professionals, but they make mistakes just like the rest of us.

If you are happy to pay legal fees on the off chance it will give you someone to sue if things go pear shaped - have at it!

That’s obviously not the primary reason for engaging a solicitor to draft and issue a legal notice.
 
So far as the sale goes, of course you need to engage a solicitor.

NOT is a different kettle of fish.

From the cases I've read, the issue is not following the process.

A solicitor will provide a materially better chance of ensuring the process will be followed to the letter.

I’m 99th percentile in terms of knowledge of Irish tenancy law and would still engage a solicitor for an NOT.

Obviously wasn't clear, if I was selling and had tenants in situ then yes I'd engage Solicitor to look after NOT etc.
If you miss a full stop the RTB/Threshold cabal will be right there gleefully insisting you need to start process from scratch before you can sell your own property

My two cents: get a solicitor to do it. But also check it in detail urself.

Recent experience has taught me that even solicitors, terrific as they are, can trip up on the minutiae.

I could write a thesis on how the RTB / Threshold machine is built to make ur life difficult.
 
Thank you all for the robust exchange of views...... I had decided to use a solicitor before posting and my mind hasn't changed. I'm looking for recommendations for a solicitor who has done this kind of thing in the past and provided a good service, thanks.
