11July 2022. Can my tenants who will soon complete their 1st year of Tenancy under a fixed 12 month lease now refuse to accept a further fixed term lease because of the recent changes to part 4 regulations?
 
Forget the fixed term lease, the legislation overrides whatever you agree with your tenant. Once a tenant is in situ for 6 months, they are effectively entitled to a lease for life. You can only get back the property if you are selling, moving in yourself etc. After 6 months, your tenants can stay on forever unless you are selling - it doesn't matter a jot that your lease says 12 months.

There is no reason for them to do so as their Part IV rights override any lease you ask them to sign.
Correct. Its worth offering a lease for first year to establish the relationship but after 6 months it defaults to Part IV anyway
