Hi
If you purchase a tv and it is faulty from day one are you entitled to a refund??

You are entitled to a replacement or a refund if the goods are not fit for the purposes sold. See ConsumerConnect and [broken link removed] for example.

Presuming you notify them within a reasonable period of time (widely accepted to be 28 days) of the fault then yes you will be legally entitled to a replacment or refund if you insist.

This doesn't apply if you have kept the tv in the box for six months before going back to the shop for example. In that case it would be repaired.

There is no definition within legislation as to how long a period of time must pass - i.e. there is no definition of what is a "reasonable period". 28 days may be widely accepted, but it is not definite.

If I had a tv in a box, stored behind my sofa, and hadn't opened or interefered with it (for example a to be opened when I moved to my new house) and opened it 6 months after purchasing it and it didn't work, then I would be very much within my rights of going back to the seller to get a repair, refund or replacement.

There is also no definition or guidance as to which of the remedial options that a retailer has to provide between repair, refund or replacement. They can chose whichever one suits them as long as they're acting (or appear to be acting) in good faith.

I brought a TV back to Powercity 3 times within 7 months [it stayed in mono for a few minutes on turning on].
The first 2 times they repaired it but it didn't make any difference. The third time they didn't check it, just looked at the documentation and gave me a credit note. Excellent service, I would [and did] buy there again.
