RAS to rent allowance

Hi all,

I'm new here & looking for some advise. I'm not sure if i'm posting in right forum...my apologies if i'm not, mods feel free to move.

I have been on the RAS scheme for the last 4 yrs. During these 4 years i have been in a living nightmare, I have been the subject of on going anti social behaviour on a daily basis which has gotten worse. I requested in writing a transfer a year from DCC, & also have letters from my GP & TD's. The Gardai have also offered to speak to DCC on the matter. I am still in the property as DCC said they no where else from to go.The house i'm living in was put on the market in Jan & DCC were informed of this plus my contract is up in less than a year.

I received a phone call from my landlord last week informing me the house is now sold & i have till the end of aug to move, he has also informed DCC of the same. The council in turn rang me saying they have nowhere to put me as they have no properties available except in the area i'm already in, which i do not want to take.

So my question is..(at last i hear you say) Can i go to my CWO & explain my situation which i feel is exceptional, & apply for rent allowance till DCC can find me somewhere?

In general, persons moving from local authority accommodation without good cause are not entitled to Rent Supplement.

People who refuse Local Authority Accommodation (including RAS accommodation) twice in 12 months are also excluded from Rent Supplement.

You will have to explain the reasons why you have to move to private rented accommodation to the SWA officer - there is no guarantee that Rent Supplement will be granted since the local authority are making an offer of accommodation.

With the Ras scheme you have to go & view the property & refuse it in order for it to be classed as a refusal. I have no intention of viewing the place as i do not wish to live in the area. I understand this may still go against me if applying for rent allowance, but i have been begging DCC for a transfer from this area for over a year due to the misery myself & children have to live in.

I wonder if i brought a copy of letters i have & the Garda report would it help my case with CWO?? I suppose i won't know till i try.
