Question on notice period

Hi all,

Just a quick question. I got offered a new job this morning and I am thrilled. It's just my notice that I am worried about as my current boss is not a very nice person and wil make this as complicated as he can.
I am working here for 4.5 years and I have to give a months notice according to my contract of employment plus we are paid monthly. It would be simple enough only for I am going on two weeks holiday on from July 2nd which are booked since last year and my annual holiday entitlement is 22 days.
So, I am confused as to what start date to give my new employers who have suggested July 23rd due to my holidays and notice period. That means I have really 2 full working weeks left here before I got on hols and when I come back. Does that sound allright or do I have to stay until the end of July coz I took my holidays?.

Holidays can count towards your notice period.

So that means I could hand in my notice tomorrow and leave on July 20th which includes taking my 2 weeks holidays.

I am just worried that he will go mental (okay he will go mad:( ) at me that I am leaving so he will come up with all sorts of crap to say I either cannot take my 2 weeks holidays or I have to work an extra 2 weeks before I quit.

Gosh it would be great if I can run on July 20th!!

Holidays can count towards your notice period.
Just be careful to check that you have not taken more leave than you entitled to (e.g. if your holiday year runs Jan to Dec and you leave in July you are only due a portion of the 22 days [for example 7/12ths of the total]. This should be clearly detailed in your contract / staff handbook for the specific details for your contract).

Apart from that, you are legally entitled to give one months notice and leave one month from that date, holidays or no holidays.

People often give a months notice and take two weeks holidays within that time, i.e. announce their attention to take the two weeks holiday when giving notice. Totally unprofessional in my opinion but allowed.

It works both ways, employers will often change your work for the duration of your notice or buy you out of it

Well I booked my holidays last year when we came home from our last holiday, it was so good we are going back again!. I always give months of notice for my holidays so everyone is aware of it.
Anyway, I have taken 2 days holiday since Jan, we are entitled to 22 days per annum so I am giving a months notice today to finish on July 20th. So I will work next week, take my 2 weeks off, and then back for my final week which is fine and I am being very fair after 5 years nearly of pure hell. The only reason I stayed was to have a perm job to get our mortgage!.

Write your letter of notice. Sit with your boss and give advise him that you are leaving. Adive him that you want an orderly exit and you plan to be gone by 20th July. (icluding or excluding the holidays you wish to take. )

No matter how he takes it stick to your exit date. After 5 years leave on the best terms you can, keep communicating as best you can...

Oh I know, didn't work and commit to this job for 5 years to come out with nothing, totally turned this company around and it's going to be tough on them for the first few days but sure nobody is irreplaceable!. I wouldn't leave them in the lurch, but I need a holiday, I need to establish my career more and have a better work/life balance.
