Hi,
We're currently looking to purchase a house in Cork city and we viewed a house that was newly built in 2018.I've found details online, that the builder availed of 'opt-out construction' re the new build. We're very interested in the house, and may put in an offer. Can I find out if this 'opt out could pose an issue with regards the purchase of the house?Would the estate agent be able to provide us with information on this 'opt-out construction by the builder?

He might be, but would you trust him?

In the context of Irish building regulations, "opt out construction" refers to a homeowner's option to forego the requirement of having a registered construction professional (like an Assigned Certifier) oversee and certify the design and construction of a new dwelling or extension, taking on the responsibility for ensuring compliance with building regulations themselves.

I had not heard of this before. I presume you would have to satisfy yourself, at some expense, that the house complied with good building standards. Not just as a bureaucratic compliance issue, but to make sure that it's a well built house.

If you require a mortgage, I would imagine that the lender would have its own requirements.

The BCMS (Building Control Management System) is the relevant legislation in this instance. House builders/home owners can opt in or out of this. Either option requires the owner to register their proposals but if they then choose to opt out they won't have to submit various amounts of paperwork/certificates and won't have to engage a professional to oversee the works but they won't get a final certificate of completion which is the icing on the cake so to speak.I

However the home owner / developer must ensure the works comply with building regs and planning conditions. Certificates or opinions of compliance will be required when a house is put up for sale.
