Q about nonpayment of Planning Financial Contributions

Hi all,

This is my first post here, I've been a long time lurker!!

I had a discussion with someone last night who hasn't paid the financial conditions on planning permission he got to build his family home. The house is long finished, they're in it nearly 8 years. We were wondering can the County Council still sue them for the amount owing. My friend said they couldn't as the debt was owing for longer than six years. I reckon they can because otherwise it would be easy for everyone to avoid paying the charges, by just delaying it for years.

Would love to hear opinions on this, I couldn't see anything on the county council website or on a google search.

Normal planning conditions become actionable at year 5 to year 12. This is because the permission must be complied with within a 5 year window. So year 8 would be within the window.
I'm not certain of what the situation with financial contributions is however.
 
councils are strapped for a cash, its only a matter of time before an audit of non-payment of contributions will happen..
