Pure Telecom, Airtricity and Next convicted for spamming customers

Energy company Airtricity Ltd, clothing chain Next and Pure Telecom given court convictions



Fair play to the Data Protection Commissioner but he must be completely disheartened by the fines


Pure Telecom was fined €500, Airtricity has to pay a €75 fine and Next was fined €100.


Their excuses were that they had used a third party company for the unsubscribe process; a third party agent to make the calls and an out of date computer.



Airtricity had been given a formal warning before while Pure Telecom had been convicted in 2010.



From a purely commercial point of view, it makes sense for a company to cold call. The risk of a conviction is tiny and if convicted, the fine is meaningless.
