purchase - hair curler not working

Just purchased a hair curler last week and only got round
to using it yesterday. It is working but it its not doing what
it is supposed to do!! curl my hair... Because I have thrown
away the inner packaging - and used it the shop assistant has
advised me I cannot get a refund. She said it is functioning which
i understand but when its not performing the job would i be entitled
to take it back and get a refund can anyone advise??? It cost me
40 euro.

So if it doesn't curl your hair how can she maintain that it is functioning?

Are you following the instructions correctly? Sorry to ask, but I once sold electric goods and the number of customers who came back reading me the riot act about the stuff not working was staggering. A quick demo of the offending item and they usually went away red-faced...

thats exactly what I said to her on the phone, but her reply was
because I have thrown away the inner packaging and have used
it. Do you think I should take it back?

Well its very straight forward to curl your hair. There is
nothing to it really so I am certainly not using it incorrectly or
anything.

Look up the Sale of Goods and Supply of Services act. Sounds like it is 'not of merchantable quality' and 'not fit for the purpose for which you bought it'. Go back to the store, ask to see the manager/supervisor, quote the Act and ask for your money back.

Sheena 42:I am fairy confident that babyliss made more than one of these hair curlers. So if yours is not doing what its supposed to do maybe they will replace it with a different one which should work. If the retailer doesn't offer to exchange I would email babyliss.
