Public Holidays Falling at weekends

Hi Folks

Was wondering if I could get some input on how your organizations handle situation when a public holiday falls at the weekend. Such as St. Patricks Day, Xmas, Stephen's Day, New Years Day.

We have people provide cover at weekends for which we grant them 0.5 Days in Lieu +€75 per weekend day worked. So if someone works a full weekend they could take 3 days off (weekend days they should have had + the day they earned) in the remainder of the qtr and have €150 paid into their salary.

If someone provides cover for a public holiday we grant them 1 Day in lieu.

We are now looking at cover for Xmas this year where Xmas and Stephe's fall on Sat and Sun. Are the 27th and the 28th actually the public holidays?

How are we legally obliged to compensate them? And how should we compensate them? (note there is a difference!)

Should 25/26th be compensated as weekend + public holiday?
Are the 25/26th actually public holidays or is it the 27/28th this year?

Would value some comments and input about what you guys are doing.

Am open to correction on this!

If they are due to work at the weekend they would be paid as normal, i.e. your rates above if working. The bank hols then would be a normal working day. If they are not due to work on the days they would be entitled to bank hol pay on the Monday and Tuesday.

Public holidays falling on a weekend

Where a public holiday falls on a weekend, you do not have any automatic legal entitlement to have the next working day off work. This occurs in 2009 when St Stephen's Day (26 December) falls on a Saturday. This means that Monday 28 December 2009 is not a public holiday. When this happens you are entitled to the normal alternative arrangements concerning employment and public holidays that is:
  • A paid day off within a month of the public holiday
  • An additional day of annual leave
  • An additional day's pay
  • The nearest church holiday to the public holiday as a paid day off.
