Prsi not paid by employer

My husband's working hours were cut in November and he signed on for jobseeker's benefit for 2 - 3 days per week only to be told his previous employer did not pay his prsi for 2010. He still has not received any sw payment and has had two meetings with sw officials who say they are investigating this. We have supplied his p45, previous p60s, a previous letter from the tax office in relation to his employment in 2010 with this employer and have detailed all of the history in relation to the employment, he was never given payslips even though he asked for these frequently. The employment ended due to an accident my husband had at work which meant he could no longer work in this field. His employer filled in a sw form for illness benefit at the time detailing that the accident happened at work etc. Sw are now asking for documentary evidence of the employment again. The only other item we might be able to get are copies of cheques paid to bank a/c by employer. Has anyone heard of any such cases & what outcome they had?
 
Sorry to have to tell you I have come across many such cases. You are certainly not alone. One should always be concerned at the lack of payslips, and alarmed at the lack of P60's.

Many people do not read carefully their payslips and P60's. It is vital to be watchful of the PRSI section.

It appears that SW are taking a dim view of the situation and are investigating it. If they can find sufficient proof that OH worked on the dates and times stated they may restore his PRSI payments as credits rather than contributions. This may not help your situation at the moment.

They will also deal with the employer.
 
If the accident occurred at work then the normal course to take would be to apply for Occupational Injuries Benefit but as this payment is based on PRSI it would not be available to the OP.(The employer did not pay the PRSI)

Would you consider a civil action?
