Prove you have no interest in house to get on the Housing List

Hi all,
I'm living in my ex partners home, kids together, no equity and it is due to be repossessed at some point. Very long story so I won't get into it but I am currently on the housing list as they previously accepted that I had no financial interest in the home.

However now the council are looking for an up to date letter from my solicitor to confirm I have no interest in the house.

I am certain that I don't as we were never married so I didn't gain rights under the family home protection act. I also don't think I would have gained any under the cohabitation redress scheme and we split up almost a decade ago and the limit for getting a court order is 2 years after the relationship ended. They had proof that there was no equity in the house 2 years ago, just a lot of debt and it was going to court. I have no contact with my ex since then.The lady from the council said to me that my ex could have won the lottery in the meantime and paid it off for all I know and so I could have some rights Even if he did win the lottery I still don't believe that I could possibly have an interest in the house as it seems to only be the family home protection act and the cohabitation redress scheme which give you some rights and neither apply because as I said we aren't married and haven't cohabited in a decade. Am I correct?

I never had a solicitor and I'm unsure how much it would cost to get one and I don't have money for one at the moment. Would free legal aid help with this?

Approach a solicitor to see how much it would cost for a letter.

Make it easier for them and download the folio from landdirect.ie for €5 yourself. It will presumably show your ex-partner’s name on deeds and a charge from the lender. Your name should not appear.

In the meantime send the folio to the council.

There's more to this than getting a copy of the folio, which of course the council will already have.

A folio is not a certificate of beneficial ownership.
