We are in the process of buying a house and selling our house. We were expecting to have a closing date set for a couple of weeks time.
Complete curveball on Friday when buyers solicitor requested letter from an architect confirming that the extension we had done in 2017 was not outside our boundary line. Long story short we discovered that part of our property is showing up as part of the common areas owned by the Management Company. Our architect confirmed the part of the property is definitely ours and sent me a map. I sent map on to my solicitor. Solicitor said its not a Land Registry map so no good and taking it up with the Land Registry would probably make no difference and take too long. Advised us to contact the management company and ask them if we can purchase that portion of the property etc. As you can imagine, being in a chain this is not good.
I eventually this evening managed to find an email from solicitor in 2009 sending me a copy of the certified map (thankfully).
I'm extremely disappointed with my Solicitor’s communication on this, basically we were told it doesn't matter what you think you own, the management company own it now so just get on with asking them to sell it to you. 'I can't go any further with this because you can't sell what you don't own'.
So is this a Land Registry mistake? The piece of land is only a few feet but it's definitely not due to map digitisation.
Anybody any experience or advice on how to get this sorted quickly knowing that the Land Registry take forever with everything. Should I ring Land Registry myself or leave it to solicitor... TIA
