Promotion not advertised

Hi,

My company has created a new position in a different dept for my supervisor and also promoted a colleague who would be considered around the same level as myself to the supervisor position. Neither positions were advertised, we were literally just told the changes have occured. Also both people in question are good friends and no doubt my previous supervisor had an important role to play with regard to recommendations of my new supervisor.
To my knowledge by law do they not have to advertise these positions?
Also, what would the repercussions be for the company if I were to take action?

I assume it is a private company as opposed to semi-state type.
Why on earth would you think that they had to advertise?
If they own the company they have no obligation to advertise or interview.
I hired a secetary some time ago, i didn't advertise, I asked someone that I knew would suit the job.

If I knew (a)why they had to advertise and (b) the reasons why I knew this...I wouln't have asked the question or for clarifcation in the first place!

Nevertheless, thanks for your prompt reply. I think I might have been confusing it with civil servant jobs or something.

I was also always under the impression that positions had to be advertised before being filled. Perhaps it's that they must be advertised internally before being advertised externally.
 
I believe that civil service and public sector positions have to be advertised.
Private sector companies, unless there is a prior agreement with unions, can use whatever recruitment methods they please, be that advertising for the role or not.

If you feel that strongly about the issue why not approach management directly and ask them why you were not considered for the role? If nothing else this could prompt you to (a) focus on the areas they feel you need to improve on to merit a promotion or (b) look for a job elsewhere.

If your company is unionised it may be a part of the procedural agreement that positions should be advertised.
 
There is no obligation under irish law to advertise vacancies (internally or externally). In the civil and public service (local authorities, health boards, guards etc) vacancies are advertised as a matter of course.

In the commercial semi state sector (Bord Gas, ESB etc) people are regularily hired without advertising (internally or externally).

Finally some private sector firms have agreements with trade unions or have HR policies which dictate that postions are advertised internally and externally.
