Procedure under Section 24 of the MUD Act 2011

Some individual members are thinking that it may be necessary to apply to the Circuit Court under Section 24 of the MUD Act 2011 as we have been unsuccessful getting the common areas transferred from the local authority to the Developer and then to the OMC. There is an ongoing stalemate between the LA and the developer and such as the developer is also the majority holder in our OMC, individual members are now wanting this transfer to take place as stipulated by the above act.

So my question is has any other individual member or OMC used this process, if so can you offer any advice.
