Procedure for a struck-off company to obtain duplicate title deeds

If a company, which owns a property but has been struck off for many years, is in the process of being reinstated, and cannot find the original title deeds to the property, does it have to wait for High Court reinstatement order, and then advertise in daily newspapers before obtaining duplicate deeds from the Land Registry Office? Surely an application for duplicate deeds can be made pending reinstatement of the company; after all, they will still be issued in the name of the company, so nobody else can benefit.
 
If the company is struck off the state can take and sell the property. You will not get duplicate deeds whilst the company is still struck off.
 
I couldnt see how this could be done until the company is a legal entity again.
 
You need to look into the provisions of the State Property Act 1954. The real property of a company vests in the Minister of Finance when a company "ceases to exist". You would need to get a Deed of Waiver from the Minister of Finance (by which the Minister waives his interest in the property), which your solicitor will approach the Chief State Solicitors office to arrange.

You should be aware that the Chief State Solcitor's office can tend to move at a glacial pace...you could be waiting a while for them to do anything!
