Problem with flue from adjacent apartment

I know someone who lives in an apartment on the 3rd floor. An apartment below has recently installed a gas boiler flue fumes from which drift directly into my friends apartment window - just wodnering if there are regulations in place to stop this kind of nuisance / health risk?

The Management Company have to confirm that this installation was and is satisfactory.If your friend has a problem take the matter up immediately with the Management Company. The terms of the lease agreement applicable to the apartment should state the dos and don'ts of what can be done.
 
There are building regulation which cover the placement of flues as well.

Is the outlet of this flue at or below the level of your friend's windows?
 
See here for the http://www.environ.ie/en/Publications/DevelopmentandHousing/BuildingStandards/FileDownLoad,1650,en.pdf (regs), and advise your friend to contact their local authority. The outlet must be at least 1m above and window.

Most modern gas boiler flues terminals are only required to be 300mm below
a window (unless it is a top hinged type, then its 1000mm)

But these are the distances on a single house, not 100% on apartments, but assume it conforms to the same standard (IS813 domestic gas installations)

Was this problem no present with the original boiler in place?
If the boiler has been recently change for a hi-eff boiler, and the plume is
causing a disturbance, a simple solution would be a plume dispersal kit fitted.

Or a simpler solution is to make a formal complaint to the MC. I would say that the OP's friend doesn't wants to know how to fix it, they want to get rid of it.
 
A formal complaint wont have any effect on flue gasses and wont solve the problem because as DGOBS says the flue is most likley perfectly legal. A friendly approach to have a plume dispersal kit fitted would probably solve the problem all round.
 
An apartment owner cannot place or fix ANYTHING in their apartment that effects other apartment owners. The property lease makes this provision very clear and has been tried and tested in the Courts. In the majority of cases a polite word is classed as a joke.
 
300mm is right but there is a side note in IS:813 (gas regs) that the flue should not cause a nuisance. I'll dig out the exact location of it later.
 
Yes Davy, that could be used (have only very seen it used in the past for plume crossing property boundry walls etc, but no reason why it couldn't be applied)

11.8 Location of terminals

11.8.1 A terminal shall be located in such a position that:

- the wind can freely blow across it at all times:

- the products of combustion will not be blown into nearby air-entry
grills,windows,or roof-spaces:

- the products of combustion do not cause discomfort to passers-by
