printer not working and lost receipt

I bought a printer in Tescos about 6 weeks ago. I always keep receipts for all electrical items, however I have in this instance lost the receipt. Anyway the printer is not working, the paper keeps jamming. A friend told me that proof of purchase does not have to be the receipt and as I paid with a visa card, the statement is also proof of purchase. I returned the printer to shop and was told that in no circumstances would the statement be accepted and that all they do when electrical items are not working is give phone number of manufacturer. I have not rang manufacture yet but I would like to know my rights. Have I the right to fight for a replacement? I would appreciate any feedback.

Every retailer in the country seems to try this on. Your contract is with the retailer not the manufacturer and the onus is on the former to either repair/replace or refund you. Don't be fobbed off.

Surprised that staff in as big an outfit as Tesco would try this on. Ask the person to write down their name for you, then insist on seeing the store manager. If it is the store manager, ask for the name/address of the regional manager. Point out that your time has already been wasted.

Under the Sale of Goods and Supply of Services Act 1980, anything you buy from a retailer must be:
 • of merchantable quality
 • fit for its normal purpose, and reasonably durable
 • as described, whether the description is part of the advertising or wrapping, on a label, or something said by the salesperson.

If the printer is faulty after six weeks, you're entitled to a refund. [broken link removed] you don't have to agree to a credit note, a repair or replacement.

Have I the right to fight for a replacement?

Yes. You only need "proof of purchase". You do not need to produce the receipt when the good is faulty. The credit card statement is in this instance "proof".

You do not need to contact the manufacturer. Return to Tesco and ask to speak with a manager. Bring your faulty good with you.
