Paypal / eBay resolution process

I bought 2 tickets for a rugby match later in the year on eBay from a person abroad who has a 100% rating on eBay. The tickets were sent by registered post. When I received them there were large stains on both tickets - one was so bad the barcode could not be read.

I advised the seller (and sent a scanned image of the problem) who told me they had sold loads to people in Ireland and the UK and had not had one complaint, they said the tickets were perfect leaving them. They asked if I could send an image of the packaging which I did.

They offered to reimburse me £184 even though I had paid a total of £318 for the tickets + P&P. I explained to them that the packaging was perfect when I received it and a colleague was with me when I opened the package and witness the large stain on the tickets. I told them I was not looking for a discount, or my money back. I simply wanted the good tickets that I had bought as a present for a friend. Like the seller I have a 100% rating and have bought tickets on loads of occasions with no problem.

They have no reverted saying that the World Cup organiserss will not re-issue tickets (even damaged tickets) and they NOW propose to refund me £284 which takes account of the express delivery and eBay expenses. They also state "I loose 542£ in this history !!!!!!" which I can't understand for the life of me.

I'm pretty annoyed at this situation and am wondering if anyone has used Paypal / eBay resolution process to rectify such situations. I don't see why I should take a hit of c.€50 because I received 2 dodgy tickets and I would not want my friend travelling to Cardiff in the hope the tickets will be ok.

Any advice appreiciated.

you could get onto the resolution centre stating that you didn't buy what was advertised.
i assume the picture on ebay did not have stained pictures of the tickets and also did not mention any marks on them.

you will get the majority of your money back but i think you will loose some of it due to paypal charges. my other concern would be 'if' the tickets are even genuine as the seller has 'sold lots' of these already!

Nope - there was no picture because the tickets hadn't been issued at the time and that's fair enough. To be honest I think the tickets are genuine because I already had 2 for myself which apart from the stains look identical -the big problem is the bloody barcode is unreadable. From what I can gather a relatively small number of people have got their hands on loads of tickets and have cornered the market.

I would prefer to use the resolution process, not sure if that affects my rating? I have a doubt about being offered initailly £184 back, then £284 and at the same time being told that the seller "is losing £542 on this deal". Something not right about this in my eyes.

if the barcode is unreadable..is it un-usable or could you still gain entry to the game..are the tickets scanned on entry to the game? have you rang ticketmaster or whoever sells them and asked if you would still be able to get in?

i wouldn't take the chance and would return them. you can always open a dispute and try get any neg f/back removed - in my experience the seller won an unpaid dispute with me, even though i had receipts for the purchase...he got my neg f/back removed but i had to keep his.. i would rather have a neg than loose out on so much money.
 
There is an excess due if you go through the ebay resolution process. I recently had to use this protection / resolution route with ebay due to a seller that sent wrong item to me (Items received not as described or suitable for use). You would probab;y have a claim here. you must lodge your complaint within 60days of sale end and it takes up to 90 days to resolve it. All correspondence and proof of payment are needed as hard copies.

Beware though - ebay deduct an excess from the total price you have paid. It may be worth checking the site for the specific amounts ( if your claim is successful). You may be better off accepted the proposed refund from the seller...
 
Onekeano, just wondering if you use the Paypal/ eBay process or if you just took the €50 hit as I am in a similar position at the moment. If you used the resolution process, was it straightforward or a process to be avoided if you can?
