Hi all,

I just have a question about tax. I started working for an employer a few months ago and gave him my pps number. He told me that he would pay every two weeks but told me i would be on a P35 and would get a pink slip off him to claim tax back.
I am working elsewhere now and trying to get in contact with him but to no avail. How do i claim some of the 35% he deducted off me every two weeks

You should have received a Form P45 when you ceased employment. Do you have this?

Ring the Revenue and request a P21 for 2008 - this will give you your overall tax position for the year and show any refund you are due (assuming he paid over the tax to the Revenue).

You appear to have been dealt with as a sub-contractor and it is not a P35 but a C35 on which he is returning you to Revenue . The pink slip is an RCTDC ( Relevant Contracts Tax Deduction Certificate) which shows the 35%. You must get that from him. You submit it to Revenue with your relevant income details for the year. Any amounts for 2008 go on the 2008 tax return. Revenue may give interim refunds during the year depending on the case. Once you have the RCTDC forms from the main contractor you can then get on to Revenue regarding any overpayment. Remember as a sub-cntractor you are a self-employed individual and Revenue will probably look for a FOrm 11 for 2008 to be filed now to see what overpayment if any is due.
