Ownership of home if you don't own the land?

Hi, just for curiosity, myself and my husband have built a house (which is in both our names) on his fathers land which was signed over recently onto my husbands name but to avoid paying gift tax, I have to wait to be married 3 years before my name goes on the land, does that mean I don't really own anything until 3 years as he has more shares in the stake so to speak?

Whoever owns the land on which the house sits, owns the house.

However if you are married then you may have rights to the house depending on your circumstances, the amounts paid by either party etc.

Every thing depends on the individual circumstances. I would say that if you have children you should ensure your spouse makes a current will to protect you until the house is in your joint names.
