Ordered items Nov..still waiting...what can I do?

Hi all,

Just looking for a bit of advice regarding a purchase I made at a well known electrical/homeware store. On 19th November, I put a deposit on 2 identical electrical products. After I left the shop I was contacted by the salesperson to be told that I would receive one before Xmas and one early in the New Year because the warehouse or whatever (can't really remember reason) was out of stock bar one. I said this was ok. Anyway, received another call from a different sales person to say that actually there were NO items in stock and I would receive both EARLY in the New Year. When I asked her to be more specific she said the 12th. I said ok and that I would ring on the 14th if I had not heard back. Lo and behold the 14th came around and no item delivery (to the store, I will collect from them). To cut a long, long story short, I was told last week that I would have the items in a day or two which would have been Thursday...no show...Rang again yesterday and now I'm told it's going to take another three weeks.... Is there anything I can do here without getting my deposit back.......I do feel I have been VERY reasonable thus far.......Any advice would be greatly appreciated

P.S. on the receipt it says: delivery scheduled: 26/11/07

How much of a deposit did you put down and in what form (cash, cheque, credit card)?

Was the deposit refundable?

I would write to them (hand deliver the letter if you choose) requesting a refund of the deposit and cancellation of the order on the basis of undue delays. I would also check out what the statutory rights are in this situation. If it becomes awkward then you can always drop hints about Small Claims Court etc. Be polite but firm.
 
Hi Clubman , many thanks for your replies. I suppose the difficulty for me lies in the fact that if we are to cancel the order and re-order with another company a) we may be waiting as long and b) the cost of the items will increase... The main reason we chose this particular store was the price we negotiated on the items. Their incompetence however, is maddening to say the least. I will log onto the afore mentioned consumer site and see if I have any other option but short of going to the warehouse to collect it myself, I suppose I'm stuck between a rock and a hard place....! Thanks again...

Why? Surely you can walk into the likes of DID, Discount Electrical (?), Power City etc. select the items you want, pay for them and have them delivered within days?

Are you sure that even if you arrived at the warehouse the items would be there and you could collect them?

Yes I could choose any of the places you mentioned but as stated already the cost was the main factor for this choice. We simply cannot afford to pay an extra €400 for the items elsewhere.
As you rightly point out, a reduction in cost is not much good without the items but again it simply comes down to affordability. Surely it should not be so easy for the retailer to provide such a dismal service. Whether or which, if it comes to it, we will get our deposit back and look at alternative solutions, I was simply wondering if I had any other avenue to explore. After logging onto the website you recommended it would appear not.
To answer your last question, I'm sure if went to the warehouse in question, it would be the last place I would find the items.

When buying a number of items together you should always haggle even in these stores. The worst that can happen is that they say "no".

Hi Sueellen,

Yes, I spoke with the manager this evening and whilst sympathetic they feel that the matter is beyond their control due to a delay in a shipment from the supplier. After speaking to her, I am inclined to believe that they have done all they can and whilst not happy about it I have agreed to wait until their re-newed delivery date.
The problem with going elsewhere is that not every electrical store carry this line and apparently, even if I did go elsewhere, this product is not available at any retail store at all at the moment due to this delay in the shipping.
So I suppose I have to either accept the delay (the ridiculous delay!) or go insane trying to win a battle that I'm probably never going to win anyway.....think I'll choose the former!

I would be looking for a further discount for the inconvenience in this situation.
