I ordered furniture and paid a 50% deposit. I got a call to say that the furniture arrived in their warehouse today but the company was put into liquidation last week, so the liquidator has the goods. Am I entitled to the goods from the liquidator if I pay the remaining 50%? Or could he try to sell them to someone else for a greater price? I ordered by credit card and apparantely i could get a refund from the credit card company (some insurance they have?) but I would prefer to get the furniture. Any advice?

Thanks.

Hi Sue,

The problem is that although the goods that you ordered are in the warehouse the liquidator may be able to claim that there are x about of the same table so which one belongs to Sue? If he cannot answer that question then the liquidator can say none of them and either hold onto the tables and sell them as company assets. However, the goods may have been delivered on credit to the store and the supplier may in fact be claiming retention of title.

I would suggest getting your money back from the credit card company as if you do get the furniture you have no guarantees etc. attached to it despite possibly paying full price etc.
