Only allowed three days a year sick leave with pay?

Hi all,

My friend is working in a company that allows you three paid sick days a year and anything past that you don't get paid - I've never come across this situation with sick leave before. Does anyone know is this legal/usual??

Employers do not have to pay you for sick leave at all.

In general we don't pay sick pay. If we know that a long term member of staff will be out for some time we will pay them 50-75% of their pay but we never pay for a couple of days off with a cold etc.
AFAIK most SME's don't offer sick pay either.

Same here. The Co. I work for don't pay sick leave under any circumstances and if you are more than three days out you must provide a Dr's note at your own expence. Just to prove you are "sick". Any compensation must be claimed for from the state.

Any employer I have worked for has paid salary in full for sick days although possible up to some time limit that I never hit. However this was a contractual rather than a statutory issue. In some cases the employer would claim some of the payment back from Welfare.

I don't get paid for sick leave at all, either in this job or in my last job. Usually if I'm sick for a day or two, I use my annual leave. I just pray that I won't get sick for a week!!!! Even if we have sick certs we STILL don't get paid. The employer tells us to claim from social welfare. If you are genuinely sick, the last thing you need is to be going round social welfare, filling out forms, just to get E20 a day.

I find that if I have to work during the first day of a heavy cold, I don't recover as quickly as if I take the day off.

In my previous job (multinational), we got 7 sick days paid a year. If you were out more than 7 days, you would claim from social welfare. I think this is fair.

Just checked my contract and in the current job they pay 100% of salary for periods of sickness of 5 weeks (3-12 months service) to 26 weeks (60+ months service) less any state benefit that may be payable. They also provide PHI paying 75% of salary once the limits above have been reached and until the employee returns to work or retires.

In my previous job it was 10 weeks paid sick leave in any 12 month period with further payment during sick leave at the company's discretion. I think that every other job that I had provided similar cover.

Most of the employers I have worked for state in the contract of employment that sick days will not be paid and also they require a doctors cert for absences of 3 days or more.

In my experiance only 1 employer didn't pay for sick days...well they did pay but you "owed" them a day which was repaid by overtime. I reckon most reasonable employers won't stop your pay if you are out a few days a year and its really a clause to stop people taking the p**s.

Me too - no sick pay, wages deducted for any days sick. Last year was off two weeks unpaid with flu and received a call from the boss - telling me he was taking on a temp the following week if I didn't get better by then so out of the sickbed and into the office!

What type of boss have you got tomthumb, If they where paying you sick leave fair enough he could call you while you where out sick but if not i would not be forced back until i was better and would not be taking his calls. We do get sick days in my company and my boss is ok and would never phone to check up on and if she did you know she is genuine.
