Once probate is completed

I have been left a house by my grandfather. The will is just out of probate. The solicitor is saying it could still take a few months until it is transferred into my name which doesn’t make sense to me. I thought once probate was completed it should be quick enough. My father and uncle are executors and they have been left money between them which the solicitor said they should have in the next week or two. Any advise would be really appreciated.

There are a set of steps that need to be taken before the house can be transferred into your name. None of these could be done until probate is granted. You can ask what the steps are and how long each will take, and some like gathering the deeds, making sure there is no outstanding mortgage, will probably already be done. Local property tax, can be slow as you are dealing with the local council, and the solicitor may need a certificate from them before he transfers to you.

Your father and uncle will be able to give you a better idea of the specific next steps.

Thanks for the reply. It’s out of probate just a week ago. My father and uncle are not great at communicating or getting things done. I think I will contact the solicitor myself

If your father and uncle are the executors, they’ll need to sign an Assent transferring the property to you.

However, before this happens, they in conjunction with their Solicitor will need to ensure certain things are cleared before the transfer can happen, if applicable e.g. clearance of outstanding taxes and debts owed by the deceased.
