My contract states that I am required to give 3 months notice. I am negotiating an exit package with my company at the moment, they want me to exit end Dec. I want to serve my notice, if they insist that I leave end Dec are they obliged to pay me my 3 months?
thanks

Hi Byzantium

You say that you are required to give three months' notice.

But that does not mean that they are obliged to give you 3 months' notice.

If the contract does not specify this they are obliged to give you the minimum notice as set out in statute which depends on how long you have been working there.

Termination of Employment
The employment may be terminated at any time by the service of notice by the Company in accordance with the terms of the Minimum Notice and Terms of Employment Acts, 1973 - 1991. In the first year of service, one month’s notice by either party will suffice; thereafter three months’ notice will be required.

That is reciprocal notice. They must give you three months' notice if you are there over 1 year or pay in lieu.
