Hi, I live in Spain and I have a house a few years that was used by family to live in and I also sometimes stay when I visit Ireland. I have just realised that in Spain we have to fill out a 720 module and I never did this as never heard of it and because not rented I never looked into it. In the last few months due to illness I decided to rent it and registered it for rent and registered with revenue etc and rtb.. but I am nervous now as I have never heard of the 720 module until now. Has anyone had a similar issue and not done it but done it later and what happened? Spain gave massive fines before for this and I know in 2022 this changed as they had to change this as fines were 5000 euros- 10,000 euros etc and some went to 150% fines which went to the eu court.. I am just reading up on this now..

OK you need to go to a Spanish tax advisor. If you are a Spanish resident you need to complete a Modello 720 before 31st March and declare all your assets both in Spain and overseas if any category (cash, bonds, property) is valued at more than 50k. If you declare your Irish home to the Spanish tax man and later sell it you will be liable for significant CGT in Spain.
However- if you are filing as non resident of Spain yearly you do not need to complete this as your tax residency is Ireland.
You will be advised that if you are more than 183 days a year in Spain you are deemed tax resident.
Get qualified advice.
