non national child benefit

Hi all,

I know a Brazialian girl who has been here 5 years (has visa) and has a two year old son by an irish guy that she's no longer with, Aparently the child is not entitled to any child benefit or the mother to any single family supplements due to her non nationality and the fact that she is no longer with the childs father. Is this the case? Has she any entitlements given her son is Irish?

1st she qualifies becos she satisfies the habitual residence,shes stayed here more than 2yrs,and her breaking up with her boyfriend doesnt make her baby less irish,what has her nationality got to do with the entitlements?

Wrong on the habitual residence.

A person can be here five years and still not satisfy habitual residency.
Length and continuity of residence is only one of the five factors that is considered.
