My father has been trying to make a claim for the NCOAP for the last number of years.

His last assessment was in April 2007 and was refused on the grounds that his Weekly means were assessed at Eur27.76 over the limit

Statutory Limit 227.50
- Assessed Weekly Means 245.26
--------------------------------
17.76

I have two fundamental questions:
1) The weekly means is assessed soley on his spouses teachers pension. 50% of her pension. Is this always the case in the means test and is there anything that could be offset against my mothers Teachers Pension?
2) It seems a little unfair that there is a cut off limit and not a band system.

I'm going through document SW116 from the Citizens information about making a new application since the appeal/review period has expired for the last application in 2007.

Also, there was talk of this in the European Courts a few years ago but I can't seem to find any information on the Means Test in European Courts.

The Statutory Limit in 2008 is €237.50 so it looks like he is still just out of the net.
Does he have any PRSI contributions at all during his working either in this country or abroad

So now he's €7.76 over the limit (Based on mothers pension from last Tax year. I don't have the figure for my mothers teachers pension for this year.). We'll see whether the application will be rejected this time, probably will.

Looking at his records he has one year of self employed PRSI contributions.

For the other years
*1988/89
1989/90 - PRSI Contribution paid
*1990/91
*1991/92
*1992/93
*1993/94
1994/95 - No tax assessment for
1996 - The last year he reached 66

*He did not pay any PRSI contributions these years but his reckonable income was less than £2,500 so he was not liable to pay social insurance contribution.
 
Did he have any contributions way back in his early years perhaps in the 1960's. Many people forget about those ones or think that because its so long ago that they would not be relevant.
 
He can only track down some of his stamps from post 1953 but they do not go anyway close to the required 260 figure. Is there a way to check his pre and/or post 1953 contributions?
 
Yes he can check any contributions made by him at any stage of his life by writing to the Central Records Section, Gandon House, Amiens St,
Dublin 1.

It will take 6 weeks or more to get a reply.
If you think that he might have any chance of a part contributory Pension send that record with the Contributory Application form to Pension office
