I got a new 3 piece suite from Classic furniture Navan, we took the hire purchase agreement, pay nothing now and pay full amount in a year.
New suite arrived, two fairly blatant holes in sofa, i refused delivery and sent it back to be repaired. We were without a sofa for 3 weeks until the repaired one was re-delivered. New sofa came, thought it was fine, accepted delivery. Then discovered a desperate creak, when we sat on it, got off it or moved, rang Classic immediately, they said they'd put it back through the complaints procedure again, would take ten days. In the meantime, i discovered 3 more faults, The frame was bowing in the middle, another hole and the zip on one of the arm rests wasn't matching zip on side panel, leaving arm rest hanging off.I phoned must days to get up date, eventually furniture assessor came out. Showed him all faults, he reported that he'd have to take side panel off to fix creaking noise, put 2 supports in to back of sofa to stop it bowing, fix zip and sow hole. I explained that this was not good enough, as it was a brand new couch and shouldn't need 2 extra supports.
At this stage, Classic are refusing point blank to replace my sofa and are only offering a repair. I have tried to reason with them as they have already repaired the sofa and this has proved unsatisfactory and now i would like a replacement, and of the same quality that i sat on in the show room. I have asked them to take it back which they have also refused.
I've been to my solicitor, who also agrees that i am within my rights to have a replacement or a refund.
I've been in contact with the consumer agency, who have also stated that due to the repairs not being satisfactory, that i am entitled to a replacement or repair under the sales of good act. I then intended to go down the small claims court, but due to our agreement being a hire purchase agreement it is not possible. I have said that i will go to radio talk shows,But company is still not budging and i'm still stuck with my faulty sofa in my house.
If anyone has any advice or a similar problem, i would be so grateful, and sorry about the long mail.
