New phone has old msgs and call logs

I bought a new Nokia E72 on contract and as I was going thru the call logs and there was old calls and msgs still in there.

Any suggestions on what to do? Refund, new phone?
 
oh dear I wouldn't be happy with that at all, I would demand a replacement or refund if I were you.

The phone was obviously not new, if it has calls and msgs . .............Are you sure that these are not coming from the sim card which was put into the 'new ' phone .?
