Good evening,
I intend registering as a sole trader soon. The business name I decided on I see, is already in use by someone in Australia.
I intend only operating in Ireland.
Would it be ok to register with the same name here in Ireland...I thought it was original but someone else thought so too !

I believe the answer is yes, that you may register it. I am not an expert though.
My understanding is that if the name you wish to register is already registered here in Ireland your application will be refused.

The name I already registered with the CRO is in use in the UK already, but as I am setting up as a service provider with no intention or prospect of providing service outside my local area I'm confident I can use it .
I did confirm that it isn't trademarked, if that's the right way to put it.
 
You can apply to the CRO for either

(1) a Registered Business Name (RBN). Duplicates are permitted, but the RBN may not be the same as or confusingly similar to either a Company name or trade mark.

(2) a Company Name. The rules for this are different and include uniqueness.

If the Australian business does not trade here at present and does not intend to in the future it is unlikely to be an issue.

Untrue for business names.

If you don't believe me, do a business name search on Core.cro.ie for The Market Bar.
 
I focused on the OP registering as a sole trader and therefore assumed it was an RBN (s)he intends to register.

Apologies all if my post was misleading.
