Moving a boundary between two properties I own, what is involved

Just wondering do I need to involve a surveyor, and or a solicitor to move a boundary between two properties we own (no mortage on either of these)? Can this be done without either of these professionals?

Thanks for any advice offered.

Hi 3CC, thank you for getting back to me. Yes, the 2 properties are shown as separate folios on the land registry. And yes, we are moving the boundary probably by about 20-25 meters. Currently one of the boundaries is very close to the house we are living in giving the majority of the land to the other house.

Agree. The boundaries will need to be updated with the Land Registry - otherwise you will have an issue when you go to sell either property.

So in order to define the change, you need a land surveyor or engineer to prepare a drawing of the new boundary line which you can send to PRAI.

Effectively what you are doing is splitting the folio which is to be reduced in size in two. The reduced section will then be included with the other folio in any future sale.

You will also need a solicitor to deal with the legal issues. This thread describes the process. Link

It will be a transfer between folios. It makes no difference if its the same owner or not.

As said above get the transfer map done and see your solicitor.
 
It's a simple job for a solicitor once the surveyor/engineer has the map done but there are long waiting lists in Tailte Eireann for any mapping so you would be better off putting in the application now. If you wait until you 'need' it, it will be a problem.

Thank you. There are no legal issues, as we are literally just moving the boundary on an acre which are on two separate folios.
 
Just move the physical boundary to where you want it.

There's no point whatsoever in updating an imaginary line on a map when you'll continue to retain ownership both sides of the line. It’s a total waste of time and money.

Also, the last time I heard you can't transfer property to yourself- it seems from your post that there's no question of the boundary per the folios being incorrect, you just want it somewhere else.

When you eventually want to sell/ transfer one of the properties to a third party then you just sell part of the relevant folio with map done by surveyor etc. It's very straightforward and very common- every new house you see involved a transfer of part of a parcel of land, and it'd be rare to never the split would be done before the sale.

A much bigger concern for a future sale/transfer would be any shared access, water and sewerage/septic tank. Those CAN'T be sorted out in a couple of weeks.
