HI

I have just been swiped by the side of a Dublin Bus as it made its way through a 2 lane turn of which I was on the inside lane.

I was stationary and completely within my lane as the bus pulled through and as it carried forward turning in the direction across the front of my car the side of his bus swiped the front corner of my bumper.

I am happy that it was 100% the drivers fault and he would not comment what so ever as I am sure they are trained.

We swapped details, logged the incident with relevant parties and took a witness name.

My question is has any one gone through similar and how did it pan out?
Did they get the impression that DB fought the claim or admitted liabiltiy and most importantly, if you thought you were in the right and had reasonable merit to believe you were, did you win the claim.

Thanks for any advice

if you were stationary I don't think they would have a hope of fighting it...

A lot of companies that have a big fleet would pay up if the bill isn't huge. I take it there was only material damage - no personal injury claim? I'd say contact DB's tranport manager tomorrow and request the OK (by email or fax) to have your car repaired.

Best of luck.

Will contact the claims guy tomorrow so. The bill may not be too cheap as it will be a whole new bumper and there was a very minor damage done to the body work over wheel arch so if this whole panel needs replacing too it could be costly.
cheers fingers crossed

Discussing the specifics of any claim against a well known company on a public discussion site could prejudice your case.

Lock it so!
But I do not see how the above can be linked to any specific case or further still be used in any way.

That's up to you of course-if you can't see how it could prejudice any claim, then fair enough.

I'm not acting as a Moderator here, just making an observation.

I had an accident with an ESB truck a few years back - the driver of the truck was 100% at fault (hit me from behind when I was stationary). Although his attitude was far from helpful (down right ignorant) at the side of the road, the ESB were very proactive in getting this sorted out.

Something similar happened to a colleague of my mum's a few months back, I think the bus pulled out on her and she went into the side of it. DB admitted fault immediately. She wasn't really hurt but the car was wrote off. The car she had was nothing special, couple of years old, 1 litre, but she did get a brand new car out of it (think it was a new micra or a ka maybe, but brand spanking new. And she got a courtesy car to use until she picked her new car and had it delivered. Needless to say she went no further with it after that.

A friend of mine was hit by a squad car.
He was stationary and had a big air horn fitted to the van.
Driver should have been able to hear it like.
Made ****e of the front of the van.

The Gardai dragged there heals a bit took a few months to sort out.

was in a similar situation with DB about 2 years ago ... I simply got an estimate for the damage and sent it on to the claims guy in DB - got a cheque for the full amount about 2 weeks later - no hassle at all ... it's worth noting that the Gardai were called to the scene as the bus driver disputed liability.

All good so far, looks like a whole new bumper and there is minute damage above the wheel arch, this whole front/side panel will need replacing too.
I can forsee 2/3k for repairs...to get quotes today.

Just FYI - Dublin Bus don't have insurance - they 'self-insure' via a large bond posted with the courts.
