Hi All,

I am about one week from closing on a house. I got the loan offer and I only had to get the house insurance and the cheque would be issued to my solicitors. I had given my separation agreement as part of the mortgage application and all was ok.

My solicitor had to send the separation agreement again to the banks legal team my solicitor said this was the norm and I thought all would be ok since the bank was cool when I applied with my separation

The bank solicitor's responded basically saying we wont issue the cheque until the divorce is completed and then we can.

I am absolutely in shock at this news. Is there anything I can do as I possibly will lose my dream house? I personally think this is disgraceful the banks can do this last second.

my understanding one once the loan is offered they cant back out?

Banks can back out any point in the process.

The figures that banks and the CB use for publicity are based on approvals so they have been approving almost everyone, then coming up with reasons not to allow the draw down later on.

Issues around family law are probably why they don't want to proceed. One option would be to ask if you get a specific clause added to your separation agreement about the house stating that your ex has no claim to the house would they accept that.

Your Solicitor should have come across this before, there are ways round these things, what has he/she said?
