I bought a property in 2001 which I rented out shortly after purchase. Up until recently it was elected as my PPR however I have now fully regularised this with the revenue re income tax & stamp duty clawback. I was also in receipt of TRS on the mortgage on this property which I have now repaid in full.
My husband and I bought a PPR in 2005 however the house is in his name only as he was a first time buyer and hence availed of a FTB rate of Stamp Duty. (This was advise received from professional accountant ).
We are assessed separately for TAX purposes.
Can my husband claim TRS on our PPR at the FTB ceiling being that he is a FTB ( taking into account I have an investment property)
Can he claim this going back to date of purchase ie 2005 ?
Going one step further can we claim the married ceiling of 16K or are we excluded from this on the basis that (a) I am not a FTB and (b) we are not assessed jointly
