Mortgage amount too much, what happens

Hi, we paid a 10% deposit on the house, but got a 92% mortgage, so the difference is about €5000. We didn't really have it at the time and we're sort of banking on getting it back.
What exactly happens in this case, the bank said at the time, "that will cover your legal fees" but now I'm not entirely sure what happens.
How do we get the money back at the end?
Do the bank pay the builder and he gives back the difference? Or is it all sorted out before hand?
 
the bank transfers money to your solicitor, who will discharge you o/s liability to builder 90%, take its own costs out and should give you a cheque/draft for the balance, which is your to do whatever you want.
 
All of the money from the mortgage company goes to the solicitor. He/she then pays out what is due to the purchaser of the house and also takes his/her legal fees out of this. Whatever is leftover will be refunded to you by the solicitor when the sale closes.
