I Will know 2nd December if I got a new job, I am working 3 1/2 years in current position , Boss might expect 1 month's notice, so if I got the job and as we finish 22nd December for Xmas back on the 3rd January, So if I gave my notice 2nd december could he have any complaints even though I would not actually be working the full 4 weeks due to Xmas break. all xmas days which I have off are already worked up.
 
I don't know what your contract says but if there is no mention of the amount of notice to provide or if there is no contract, then all you are legally obliged to provide is one week; doesn't matter if you are paid monthly as some people think, if there is no notice clause or if there is no contract, only one week is required, even if you worked there 20 years. On the other hand, it would be a bit unfair to just leave with one week's notice (depends on the type of job you do of course)

I don't like to contradict people who give their opinions freely on this website, but the minimum notice legislation applies to both employees and employers and states that anybody with service between 13 weeks and two years have to give 1 weeks notice, service between 2 yrs and 5 yrs have to give two weeks notice, service between 5yrs and 10yrs give four weeks notice, service between 10 and 15 yrs give six weeks notice and service greater than 15 years give eight weeks notice.

Just rereading your email you've worked 3.5 years, therefore you are obliged to give 2 weeks notice.


Also if you are working for a decent employer and wish to leave on good terms it's always a good idea to give a reasonable amount of notice. There's always a chance that your new job isn't quite what you expect it to be.

Past30Now - I thought you gave notice relative to your pay period,
paid weekly - 1 weeks notice,
paid fortnightly - 2 weeks notice,
paid monthly - 1 months notice.
Surely anything else is just courtesy??
 
In the absence of something specified in a contract, you are only obliged to give a weeks notice to an employer (Section 6 Mimimum Notice and Terms of Employment Act 1973). In answer to ACA, many written contracts specify the payment interval as the notice period.
