MIR and Rent Relief queries

Hi,

I have an incling as to what the answer to my question will be but I'd just like some advice if possible. I own a property with my brother in the west of Ireland. He lives there as he works in the area whereas I only live there a couple of days a week (mainly weekends). The property is not rented out and never has been. We receive MIR at source. However, I rent in Dublin also (due to the fact that I did work in Dublin but I had an accident in April which means I now attend a rehabilitative training service).


  1. Does this mean I am entitled to receive rent relief?
  2. Is it possible to claim for tax relief on local authority services for bin in Dublin also?
  3. As an aside question, apart from bin charges, is what are the other services that tax relief can be claimed for i.e. bin charges, water charges, TV license etc but no relief on utility bills?

Thanks for any help or advice you can offer. I'm just trying to maximise my disposable income as is everyone nowadaysI'm sure :)
 
I'll just sumit a claim for rent relief anyway... I think in my circumstances it'll be fine so there shouldn't be any problems. I'll also check boards.ie and revenue.ie for some advice on the subject as I'm sure the accountants who still have work are busy with October 31st quiclly approaching.
 
Look at form 'Rent1' it states -

Mortgage Interest Relief (TRS) - if at any point you have a mortgage and are in receipt of Tax Relief at Source you should advise your Local Revenue Office immediately as you may no longer be entitled to Rent Relief and your Tax Credit Certificate might need to be adjusted.


From this i would expect that you can not claim both if you are claiming TRS on a mortgage, You can claim if your paying for private rented accommodation used as a sole or main residence. The term 'Sole and main residence' is also applicable to your mortgaged home and therefore you cant have them both.

Thanks for the response and it seems logical enough but I just thought in my circumstances, it would be different, as I do need to rent in addittion to paying my mortgage... there's just no way around it. The fact that I'm receiving MIR is worth much more to me than just gettin rent relief for a short period.
 
Call your nearest revenue office (you can find a list on the www.revenue.ie website) ask to speak to a TAX agent (free service) and explain your situation. After all, you have nothing to lose.

Your waste charges can be claimed at the end of the year (ie 2008 will be claimed in 2009) this is capped at a maximum so claim your total payments. Also recommend you set yourself up on ROS whether you’re a PAYE or Self employed, it's an easier way to manage your taxes.

As for other reliefs, it’s unlikely unless your self employed and you use this rented accommodation for business purposes.
 
As you say you cant have both. In fact it appears that as you are no longer using your mortgaged property as your PPR then you probably shouldn't be getting MIR on it. Given your circumstances, however, revenue may decide that your PPR status is OK but they would not give you rent relief as well.

Thanks all for the feedback and the opinions.. this is exactly the kindof of feedback that I wanted in order to make a decision!

I would think elcato is correct, in that the revenue might take my current situation into consideration but there's no possible way that I would get, or be entitled to both MIR and Rent Relief. But, as jsa mentioned, I may just call my local tax agent, however, I don't want to draw unwanted attention to my case plus I definetly don't want to loose MIR.

I really do appreciate all the responses and find this forum indispensible!!
 
Just one last question on this topic, I am registered with ROS and do use them to manage my taxes and have reclaimed approximately 1600 so far for various different expenses. However, is it possible to claim subsequent tax back, for the same expense (if discovered at a later date) i.e. I've discovered subsequent receipts for non-routine dental but have already submitted and been paid tax back on that by the revenue??
