Mgmt co. won't give me details of other shareholders

Our AGM is coming up and I want to talk to the other owners in my apartment complex about perhaps replacing the management company. Most of the apartments are rented so I can't contact the owners. I contacted the management company and asked them for the contact details of the other shareholders in the company. They said they will only tell me the names of the people owning each apartment but cannot "under the data protection act" give me contact details for them. Can anyone tell me if this is correct procedure?

Dont know about correct procedure, will probably find myself in the same situation in a couple of months. Why dont you put a note in each apartment marked for the urgent attention of the owners, surely the tenants will either deal with an agency or directly with owners so the letter can be passed on?

Does you mang company have shares?- If it does get company number and get last b1 filed from companies office- all names and shareholding on this form
 
As an aside you will generally find that investors are even less interested in management companies than the owner occupiers are. You should focus on contacting the owner and illiciting whether they are willing to take over the roles in the management company.

As the two are often confused, are you sure than you want to replace the management company and not the management agent. The management company is the directors who should be representative of the owners of the units. The management agent is the people you employ to deal with the day to day running.
 
Ask the ODCE to help you with this. As far as I know, every shareholder has a right to ask the company secretary for the contact details for all other shareholders but I can't find the legislation that specifies that. Alternatively, anyone familiar with company law should be able to help you.
 
As a Shareholder you are entitled to examine the Register of Members of the Company.

I wouldn't imagine that this would necessarily need to include contact details such as phone numbers? Wouldn't the management company have a duty to the members under the data protection act, and need their permission to hand out personal info?

You _ARE_ the management company. The data isn't being passed to anyone outside the company, it isn't being shared with anyone so the DPA shouldn't apply.

I think you mean "replacing the managing agent" as its (presumably) the management company's AGM.
 
As an owner you are only entitled to the names of the other members of the management company, the agent is telling you the truth. You already have their official addresses being the address of the unit.
