Med 1 claim for 07 & 08

Hi folks, I’m hoping someone can help me with this query;

I got orthodontic treatment from Jan '07 to Dec '08, but I only made the payment (€5500) to my dentist last week i.e. April '09, where he filled out the Med 2 form for my safe keeping. Using ros.ie I completed and submitted the Med 1 form today.

While on ros.ie today I noticed that medical expenses can only be calculated after the calendar year has finished. So now I’m wondering if because I only made the payment in '09, will Revenue try to say that I cannot receive my tax relief payment until '10?

And if they try this approach what is my best course of action or response to fight them on this i.e. work carried out date vs. payment date?
 
According to the revenue leaflet IT6, you can claim medical expenses tax relief in either the year the expense was incurred or the year it was paid.

It appears that you should be able to claim your expenses for the years 2007 and 2008 as they were incurred in those years. As those years have passed, you would be able to claim them now.

If you can, it'll be to your advantage if you pay tax at the higher rate (you can only claim tax relief at standard rate from 2009 onwards).
 
Ah thanks for that speedy reply gipimann, Im very relieved by that now. That 'revenue leaflet IT6' info is important info for me to have and I have the link/page found as well.
