How does it work for tax if you are taking pregnancy leave and your employer does not pay you for you maternity leave period.
You get maternity benefit from the SW. But can you claim tax back when you return to work for the months you were on maternity?
Apologies is this is posted elsewhere but I couldn't find it.
 
Many social welfare payments are assessable for tax. Unemployment Benefit/Assistance are for example. Maternity Benefit is not as far as I recall. While out of work you still have your normal tax credits and in many cases as your unused credits accumulate you will be eligible for a refund of tax paid. If you do not claim this then it should balance out when you return to work later in the tax year (since you will have accumulated unused tax credits to set against your normal income) or you can just do a reclaim at the end of the tax year if you end up overpaying tax on your total (normal plus any assessable income while out of work). While this is true, it has nothing to do with employees on maternity leave.

Employees on maternity leave are still employees and will recieve a P60 from their employer at the end of the year.

Sorry, you are right - my mistake! :eek:

Credits unused during maternity leave will be set against earned income on return to work or else can be reclaimed after the tax year ends whichever happens first. If you suspect that you have not received the benefit of all tax credits during a tax year and have consequently overpaid tax then simply write to your tax office explaining the matter and including a copy of your P60 and they will check things out and issue a refund by cheque if necessary.

Can the woman reallocate some of her unused credits to her husband DURING the period of leave in the case of joint assesment
