Made redundant and hired back by the same company - legal?

Hi,

My brother in law has been offered redundancy. He's been working for the same construction firm for the last 6 years. At the moment theres only himself and the boss employed. When things were good there were 15 - 20 employed.

The boss wouldn't be the most trustworthy of people, but he's being extra nice to the brother in law, telling him he'll get the best redundancy package he can get for him, this is very unlike him, due to the fact that he's messed around ex employees in the past, not giving them their entitlements etc.

He's told my brother in law that after he gets his redundancy, if work picks ups, he'll re hire him. Is that legal? all sounds a bit fishy to me or am I just being paranoid? Thanks in advance for your replys.
