We have been advised that there are a large amount of jobs to go in my company and the HR department has sent out a redundancy calculator.... my query is does the redundancy package have to include your length of service until the day you finish employment or can our employer advise that the length of service is only recognisable up until the date that the redundancies were announced?
I would imagine that calculator is only going to give a guideline figure as presumably you don't know finishing date yet, when you apply and are accepted for redundancy usually the paperwork you get will show the amount which will be calculated up to the date you are due to finish on. This has been my experience anyway.
Hi thanks for the reply -the date has been given as the 31st March - HR have advised that they will only calculate the length of service until the 31st October and I'm just wondering if this is legal?
If you look at the calculator tool on the DSP website, you'll see that service is to be calculated up to the date of termination - anything else would be a nonsense if you think about it - your employer could tell you they're making you redundant in 2016 and justify not including 4 years of service in the calculation...!
