I'm trying to sell my house at the moment and I'm very frustrated with my auctioneer:
1). A few weeks ago the sign outside my house was replaced by a different one, without any written acknowledgement that ownership had changed hands. I have still not even received any written acknowledgement nor statement of terms.
Is my original contract even still valid?
2). Someone put in an offer of X, half the guide price, a fortnight ago. This is far below market value and the auctioneer informed the person this. Another couple viewed the house a week later and the auctioneer informed the couple there's an offer of X on the house, which of course lead the couple to put in a bid of X + 5K!
I was fuming. All he had to say was that the owner would not accept less than Y and that there are some interested parties.
He said he's legally obliged to tell any prospective buyers the bidding history, regardless of how ridiculuous.
Is this true?
